The relevance of European Product Liability Law and Product Safety Law

The relevance of European Product Liability Law and Product Safety Law is determining also the German jurisdiction and might change the jurisdiction of the Federal Court of Justice in Germany. In the cases the Federal Court has submitted to the European Court of Justice the Attorney General has pleaded in the similar direction as this publication: A product can bee deemed defective under the Directive 85/374/EC (Product Liability Directive), if the defectiveness of a products has not been determined individually, but in the case that the product is in the scope of series with a significant ration of defects. His statement is attached.
